3. About Drive Saver and Pricing Data

3.1 Drive Saver is a consumer service that helps Australian drivers find cheaper fuel.

3.2 Drive Saver is not affiliated with, endorsed by, or operated by ChargeFox, the Government of Australia, or any fuel retailer named on this website unless expressly stated.

4. Materials on the Website

4.1 This website contains material which is owned by or licensed to Drive Saver. This includes, but is not limited to, the design, layout, look and feel, graphics, logos, text, software, and the Drive Saver name and brand. This material is protected by Australian and international intellectual property laws, including the Copyright Act 1968 (Cth).

4.2 Trademarks, logos and brand names of fuel retailers, loyalty programs and other third parties shown on this website are the property of their respective owners. Their appearance does not imply any endorsement or affiliation.

4.3 You may view, use, download and temporarily store material from this website for your personal, non-commercial use only. You must not:

8.2 We comply with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Where the website collects sensitive information such as your home or work address (for location-based fuel recommendations), that information is encrypted at rest and in transit and is never sold to third parties.

8.3 You may request access to, correction of, or deletion of your personal information at any time by contacting privacy@drivesaver.com.au.

9. Liability

9.1 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that you have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law where it cannot lawfully be excluded.

9.2 Subject to clause 9.1, and to the maximum extent permitted by law:

the App and all content, estimates, calculations, recommendations and notifications are provided "as is" and "as available" and we do not make any warranties except those that cannot lawfully be excluded, whether express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement;
we are not liable for any loss, cost, damage or expense (including loss of profit, loss of savings, fuel costs, travel costs, or consequential or indirect loss) arising from your access to or use of the website, reliance on any information on the website, or any inability to access the website.

9.3 Without limiting clause 9.1, we will be responsible for loss or damage where it is:

(a) personal injury or death resulting from our negligence;
(b) caused by our fraud or fraudulent misrepresentation; or
(c) any other liability that cannot lawfully be excluded.

9.4 Where our liability cannot be excluded but can be limited, our liability is limited (at our option) to:

in the case of services - re-supplying the services or paying the cost of having the services re-supplied;
in the case of goods - replacing the goods or paying the cost of replacement.

9.5 You agree to indemnify us against any loss, cost, damage or expense we suffer arising from;

your breach of this Agreement;
your unlawful use or misuse of the website;
your infringement of another person's rights; or
any content you submit through the website.

9.6 To the extent permitted by law, our aggregate liability arising out of or in connection with the website is limited to the amount (if any) you paid us to use the website during the 12 months before the event giving rise to the claim.

10. Complete Agreement

These Terms (including the Privacy Policy) constitute the entire agreement between you and Drive Saver in relation to your use of the website and supersede any prior agreement, representation or understanding.

11. Severability

If any provision of these Terms is held by a court of competent jurisdiction to be invalid or unenforceable, that provision will be severed and the remaining provisions will continue in full force and effect.

12. Jurisdiction and Governing Law

12.1 This website is controlled and operated by Drive Saver from its offices in Western Australia.

12.2 These Terms, and any dispute arising out of or in connection with these Terms or your use of the website, are governed by the laws of Western Australia, Australia.

12.3 You and Drive Saver submit to the non-exclusive jurisdiction of the courts of Western Australia and the courts competent to hear appeals from those courts.

12.4 Your continued use of this website indicates your acceptance of these Terms.
